Job Description

My client is one of the leading providers in Insurance and Legal services across the UK and are looking to add to their serious injury team and are looking for an experienced Serious Injury Lawyer.The ideal candidate will be responsible for running a case load of litigated and non–litigated personal injury claims involving pain related conditions.The role involves dealing with all aspects of the claim from beginning to end.you will also be required to support/mentor junior members of the team.Key Duties and Responsibilities

  • Identify vulnerable clients and ensure that correct processes are followed and to ensure that any additional time spent with the client due to that vulnerability is accurately recorded.
  • Continuously risk assess a case as it progresses and highlight concerns to your line manager to include any concerns relating to jurisdiction, procedure, liability, contributory negligence, and causation.
  • Have an excellent working knowledge of the CPR and/or and other relevant case law and/or legislation and progressing claims in a timely manner in accordance with the CPR.
  • Be able to identify subtle brain injuries and ask relevant questions to ascertain the nature of injuries suffered and escalate within the Serious Injury Team
  • To be familiar with and engage with the Rehabilitation Code and Serious Injury Guide in all appropriate cases.
  • To ensure that you carry out full due diligence to mitigate the risk of FD.
  • To identify the need for signposting to other organisations such as Headway
  • To identify the need for the claimant to be referred for a welfare benefit check.
  • To identify the need for the claimant to be referred for a personal injury trust and/or investment advice at the appropriate stage in their case.
  • To identify other relevant policies of cover in place such as critical illness/ permanent health/medicash/union benefits and ensure the client is advised about applying for the benefit of those policies.
  • To check in appropriate cases whether the client has an existing POA.
  • To be able to identify a client who is or likely to be a protected party and identify who should act as litigation friend.
  • To understand the process of the Coroners Court and rules
  • To attend if required the Magistrates or Crown Court for the hearing of any associated criminal proceedings.
  • Identify cases where an INA is suitable and draft the necessary communications to the Defence.
  • Identify all cases where the Defendant Insurer is a signatory to The Serious Injury Guide or Serious Injury Guide Lite signatories and to ensure that wherever possible cases are run by the Guide.
  • To ensure all clients are sent our standard letter on fundamental dishonesty BEFORE their first medical appointment.
  • To instruct and liaise with the client’s case manager, rehab team, support workers and professional deputy as required.
  • To liaise with professional deputy and Court of Protection as needed.
  • To identify and obtain relevant and necessary evidence (medical or otherwise), liaising with medical experts/agencies as necessary, identify and request relevant discovery documents. This will include being familiar with digitised platforms for securingmedical records and imagery, an ability to review records and reports and prepare comprehensive summaries.
  • Ensure any appropriate instructions are obtained from any relevant lay and/or insurance clients or their litigation friend where the client is a protected party.
Experience & Knowledge
  • Experience of dealing with caseloads including complex regional pain syndrome, chronic pain/neuropathic pain, somatic symptom disorder, fibromyalgia/FND/ME/myofascial pain syndrome is essential.
  • To have at least 4 years’ experience running a Claimant litigated case load.
  • Excellent client care and analytical skills, to include providing written and oral advice in a clear concise manner.
  • The ability to liaise and build up a rapport by using effective communication with all external agencies.
  • Good IT skills with a sound working knowledge of VF or a similar case management system and essential MS Office knowledge.
  • Excellent time management and organisational skills, with a calm and methodical approach to work and a flexible and adaptable attitude to resolving issues.
