Job Description

Risk Lawyer - Scotland or the NorthThe General Counsel & Risk (GC&R) Directorate focuses on strategic compliance and risk management advice and projects across Addleshaw Goddards UK and international offices: drafting and agreeing firm-wide policies and procedures; advising the partnership on regulatory issues; and assisting the firms GC, COLP, COFFA, MLRO, AML Committee, Financial Crime Advisor, Tax Fraud Prevention Officer, Conflicts Partner, Conflicts Committee and Claims and Complaints partner, on other professional issues. The group is also responsible for implementing, embedding and monitoring compliance and risk practices across the Firm, globally.The Risk Lawyer role will primarily involve the firms compliance with The 6th version of Council Directive 2011/16/EU on administrative co-operation in the field of taxation which came into force on 25 June 2018 (DAC6), The International Tax Enforcement (Disclosable Arrangements) Regulations 2019 (the Regulations) which are anticipated to implement DAC6 in the UK and equivalent implementing legislation in Germany. Whilst the role does not require any qualification or experience as a tax lawyer or accountant, it does require a degree of curiosity about tax issues and familiarity with certain tax principles.General Duties

  • a broad range of regulatory and commercial day-to-day queries from around the Firm, providing advice and training where needed;
  • advising the partnership and the Firm on any relevant changes to legislation and/or new regulatory requirements;
  • recommending and documenting new policies and/or developing procedures where current practices are informal or there is none, for use across different departments and/or offices of the firm based on applicable legislation / regulation and undertaking relevant legal research as required;
  • assessing existing policies and procedures against applicable legislation / regulation; recommending remediation actions; drafting amendments, communicating and implementing changes across different departments and/or offices of the Firm as relevant;
  • developing and delivering compliance and risk training across the Firm;
  • conflict resolution and decision-making, engaging and influencing partners, relaying Conflict Committee determinations and managing any follow up tasks;
  • AML and sanctions queries, data protection queries and higher value and/or risk procurement contracts;
  • preparation for any investigations including visits from regulatory bodies and/or other internal or external auditors, expanding knowledge where needed on any proposed agenda item; and
  • ad hoc compliance projects and initiatives as required.
  • Duties relating to the Firms compliance with DAC6
  • Working closely with the DAC6 project team to identify and test a suitable tool for the identification, assessment, recording and on-time notification of potentially reportable cross border transactions;
  • Taking the lead role in implementing the chosen DAC6 tool across the Firm;
  • Working closely with internal stakeholders and third party providers to extract relevant historical matter information from the Firms records and use the tool to assess, record and notify any reportable arrangements which are identified within the time limits;
  • Continually assessing the suitability of the DAC6 tool for the Firms needs and suggesting and developing improvements where useful;
  • Reviewing and developing appropriate training materials and rolling out a practice area specific DAC6 training programme across the Firm;
  • Assisting partners and fee earners in using the DAC6 tool and providing an administrative function to better manage the process end to end;
  • Being the point of contact for DAC6 queries and responding to partners and fee earners as required; and
  • Being the point of contact for DAC6 referrals, understanding what information is required, asking the right questions in order to extract the necessary information from partners and fee earners, performing technical analysis of cross-border arrangements against the hallmarks, escalating the assessment as necessary and notifying reportable arrangements within the specified time limit.
  • For Addleshaw Goddard (Germany) LLP the role additionally involves:
  • Liaising with colleagues in Hamburg to understand DAC6 implementation in the jurisdiction;
  • Ensuring the DAC6 tool or parallel process will identify and gather the correct information for assessment of cross-border arrangements in Germany;
  • Understanding the reporting regime in Germany and ensure reports can be submitted on time and all necessary information recorded;
  • Adapting the training materials to reflect the jurisdictional requirements; and
  • Liaising with the local tax authority.
  • Knowledge, skills and experience required
  • good understanding of all relevant regulation for the AG offices;
  • thorough understanding of DAC6, the Regulations and relevant German legislation;
  • working knowledge of tax and/or trusts law. Experience working as a fee-earning lawyer in the areas of tax law or trusts at a large commercial law firm is an advantage;
  • excellent general understanding of commercial transactions and legal documentation. Experience in a compliance or risk management role or experience working as a fee-earning lawyer, at a large commercial law firm is an advantage;
  • ability to influence partners and senior management and to communicate a compliance view clearly, succinctly and persuasively by telephone, in writing and in person. Resilience and ability to deal professionally with situations of conflict and to deliver difficult messages;
  • experience of advising on complex / technical law and regulatory issues;
  • excellent research and legal writing skills. Ability to analyse issues and draw conclusions clearly and succinctly. Excellent drafting skills for policies and training materials;
  • ability to design and deliver compliance training for legal and support staff at all levels.
