Capita have partnered with Crown Prosecution Service in their recruitment campaign for 2022.SummaryAre you a driven, talented Barrister or Solicitor Are you new to criminal law Are you looking to progress your careerThe Crown Prosecutor position is our entry level lawyer role ideal for newly qualified lawyers or those who have no criminal law experience. This role is a Magistrates Court based role where initially you would work on the more straightforward cases butshould progress quickly to deal with more serious casework.In your role you will be pivotal in providing justice for victims and witnesses, you can have a tangible impact on society and have the autonomy to use your sound judgement. Regardless of which role you decide to be considered for, a fullrange of inhouse, in-depth training will be provided to ensure you are fully supported and confident in your role.Job descriptionInitially the postholder will work on the more straightforward cases but should progress quickly to deal with more serious casework. On completion of the Crown Prosecutor 5 Learning Stages the postholder will be able to advise police and other investigators(except Statutory pre- charge advice), and undertake Advocacy, review and case preparation in summary and either way matters heard in the magistrates court.Subject to the postholder satisfying the "general qualification" provision within the meaning of section 71 of the Courts and Legal Services Act 1990, the post is designated by the Director of Public Prosecutions as a Crown Prosecutor under the terms of section1 (3) of the Prosecution of Offences Act 1985.Responsibilities To advise police and other investigators (except Statutory pre-charge advice) in a range of preliminary, straightforward and contested casework including some either way cases. The postholder will prepare for prosecutions in summary and either way mattersheard in the magistrates court. To decide based on the evidence whether prosecutions should proceed or be discontinued in summary and either way matters heard in the magistrates court. The postholder will require the ability to explain decisions to magistrates, counsel including defence, witnesses, the police and other appropriate agencies in a manner that is appropriate for the recipient. To work effectively as part of a multi-skilled team and provide support to Associate Prosecutors, Legal Trainees and other Crown Prosecutors in case preparation and generally. The postholder will need to consider the needs of others, particularly victimsand witnesses in drawing up casework plans.QualificationsLegally Qualified: The post holder must be a qualified practising solicitor or barrister and must hold a valid Practising Certificate for England and Wales.Academic: Law degree, Common Professional Examination, Graduate Diploma in Law.Professional: Legal Practice Course, Solicitors Qualifying Exam or Bar Professional Training Course and have completed the relevant pupillage and training contract (or have received full exemption from the relevant professional regulatory body, either the SolicitorsRegulation Authority or the Bar Standards Board).ORCILEx: The post holder must be a Fellow of CILEx, and in addition be a CILEx Advocate/Litigator holding all three advocacy certificates providing them with a general qualification within the meaning of s.71 (3) (c) Courts and Legal Services Act 1990. Therefore,the holder must have a right of audience in relation to any class of proceedings in any part of the Senior Courts, or all proceedings in county courts or magistrates courts in order to meet the requirements for a Crown Prosecutor specified by section 1 Prosecutionof Offences Act 1985.If youre unsure whether you have qualified through CILEx please contact us to establish your eligibility for this role.Please note the qualification as stated is required for this role and equivalent qualifications will not be accepted.Please note, the eligibility criteria stated above needs to be met by Monday 12th December 2022.
