Senior Commercial Manager Location: London (primarily working from home) Contract Length: 6 months Day rate: £383 - £439.00p/d (depending on selected payment route) **This role is in scope of IR35**About Network Rail and the DepartmentNetwork Rail is at the heart of revitalising Britains railway. This will help us deliver the better railway that is vital for the economic prosperity of this country, transforming how people travel and make a massive difference to passengers and freight users right across Britain.Brief DescriptionThe Commercial team provide a pre and post contract management service to the Southern Region of Network Rail, and all the functions and operating Routes that sit within it. Our key customers are Asset Management, Maintenance, Works Delivery and Operational teams. About the role (Internal)You will act as the senior point of contact for all commercial matters relating to the Regions Asset Protection (ASPRO) portfolio. Network Rail enters into contracts with Outside and Third parties, to protect our infrastructure from their activities, which are carried out on or adjacent to our assets, and have the potential to cause harm or disruption to the railway.The primary responsibilities will be;1.Act as a Business Partner to the two Heads of Asset Protection and Optimisation for Wessex and Kent & Sussex Routes.2.Line manage the Regions ASPRO commercial team, providing strategic leadership and acting as an escalation point3.Responsible for the commercial management of all contracts, ensuring all NR obligations are met, and all associated billing activity is up to date and accurate. Ensure aged debt levels are proactively managed and escalated as required.4.Provide pro-active expertise, advice and governance on all contract/scope changes in accordance with change control systems, recommending or authorising appropriate action within delegated authority and progressing the timely resolution of contract variations.5.Manage all commercial correspondence and contractual notices issued in accordance with contractual conditions to confirm whether Network Rails contractual position is clearly defined.6.Leading the commercial review of project delivery, attending valuation & progress meetings as necessary.7.Initiate estimating and risk & value management of projects in a timely manner during the project life-cycle, recommending appropriate mitigating actions on commercial/risk events at the earliest opportunity.8.Identify emerging problems, report contractual claims & support in the management and resolution of legal and/or commercial disputes in conjunction with Regional/Functional management as appropriate.9.Lead the final account settlements on all projects to manage close out as per the project authority, project plan and within agreed timescales. 10.Establish appropriate compliance controls and audit regimes to achieve adherence to Network Rails relevant procedures, Group and company standards.11.Responsible for monitoring and managing all project commercial reporting such that it is accurately maintained and recorded in accordance with company reporting systems. Explain all variances to outturns, period forecasts, AFCs and budget/authority to Business Partners and Programme Commercial Manager, proposing mitigating actions at the earliest opportunity.Essential Skills*Knowledge of railway and construction industry conditions of contract.*Knowledge of railway commercial contract management.*Educated to degree level or equivalent and professional qualification.*Experienced negotiator.*Experience of resolution of construction contract disputes*5 years relevant railway and/or construction experience.*Experience of managing and developing a team of staff.*Good communication skills both written and oral.Desirable*Estimating experience*Project controls experience Required skills
