Head of Commercial Law for a major player in the Pensions industry. Pension expererence for this position is not needed. As part of the General Counsel (GC) department you will have a key role to play in the long-term success of the firms. The following is a high level summary:* We provide commercial, pension and investment legal advice and technical pension support to the business. Working collaboratively, we enable the firm to meet its many obligations in a manner which is efficient, technically accurate, compliant with legal and regulatory obligations, whilst at all times maintaining values;* We develop and maintain an effective governance structure;* We provide secretariat support to the governing body and its committees, the Members and Employers Panels;* We provide input, support and advice for strategic decisions, policy making and the design and operation of the pension scheme whilst ensuring reasonable standards of governance and compliance;* We discuss and resolve policy, legislative and technical matters with the Pensions Regulator, the Department for Work and Pensions and HMRC;* We are accountable for the Order and Rules and the Employer Terms and Conditions and for any amendment or variation to them. Key Accountability* Lead the legal aspects on dealings with key commercial arrangements, in order to navigate a pivotal time of change and complexity in this area and to enhance effective and cost efficient delivery of supplier services.* Identify and work across the firm to manage legal risk in respect of the commercial aspects of the business. Work with colleagues to manage the legal and regulatory issues associated with the provision of services to both its Employers and its Members.* Provide legal support across the firm in relation to a broad range of areas - company commercial and contractual law, public procurement law, competition law, data protection and privacy, IP, relevant internal policies.* To identify and foster good practice and process efficiencies and to be a pro-active participant in a culture of continuous improvement.* As required, to successfully lead and co-ordinate a virtual team of external legal advisors to ensure the seamless provision of legal expertise necessary for complex matters.* To identify the learning needs of colleagues and ensure that legal training is designed and delivered to meet those needs.* Work effectively with colleagues at all levels right across the firm and at its suppliers to implement the above.* To be an effective ambassador for the GC team in line with values. Deliverables:* Provide legal advice, drafting and strategic input in respect of commercial arrangements and contracts. This advice will be wide ranging and may include company commercial and contractual law, public procurement law, competition law, data protection and privacy and IP.* To take the lead, as appropriate, in supplier negotiations.* Lead and/or coordinate external legal advisers, as appropriate, and business colleagues to identify legal and regulatory risk to the firm and to develop strategies with colleagues to manage those risks. Those colleagues will include, amongst others, procurement, risk and compliance teams.* Proactively identify and deliver good practice and process improvements regarding GCs service delivery.* Develop familiarity with auto-enrolment and be able to input into strategic decisions addressing those challenges.* This is a senior role and will involve presenting to, and engaging with, members of the executive team.Role requirements:* A qualified lawyer with extensive expertise in commercial and contract law;* Experience in a legal firm or in-house legal environment that is highly regarded;* Significant legal experience in large outsourcing and/or IT contracts, with knowledge of public procurement requirements and IP/data privacy;McGregor Boyall is an equal opportunity employer and do not discriminate on any grounds.
