Job Description

Your new roleThere has never been a more exciting time to work in infrastructure. The Governments second Road Investment Strategy commits £27.4 billion of spending in our motorways and major A Roads over 2020 to 2025.As a Commercial Lawyer you will advise on all aspects of contracts and procurement law to enable this spending: to build new road capacity, improve the quality of the existing network, encourage innovation and efficiency, and enhance safety, the environment and sustainability. This is a diverse role and provides an excellent opportunity to apply your expert legal knowledge and skills to NEC based contracts, IT and technology contracts, services contracts, public procurement, dispute resolution, intellectual property, asset protection, research funding, collaborative working and a range of commercial legal queries.We recognise the importance of providing face-to-face, office-based support and supervision to our junior lawyers to assist with their development. This role will therefore involve office-based working subject to Government guidance regarding COVID-19. This role has the flexibility to be based from our Birmingham or Guildford offices. Highways England is a flexible employer and home-working is also available alongside office-based working. Some occasional travel may be required to our national offices.What you’ll be leading onTaking responsibility for more routine legal matters and supporting Lawyers and Senior Lawyers on more complex matters in the following areas:

  • Providing advice to the business on all aspects of commercial/contracts law, including in relation to the procurement of high value, complex engineering and construction contracts.
  • Legal advice on all aspects of the procurement cycle, including procurement documents, stakeholder engagement, supplier selection, evaluation, negotiation, contract award and execution.
  • Drafting documents and advising in relation to services contracts, funding agreements, asset protection agreements, intellectual property, IT and technology issues and corporate law.
  • Advising on the resolution of contractual claims and disputes, including supporting (but not directly conducting) litigation, arbitration or adjudication using external lawyers where appropriate.
  • Advising on risks and mitigations associated with judicial review
  • Contributing to the preparation and drafting of reports and briefings for senior management to support the decision-making process.
  • Assisting with general and varied queries affecting the business.
  • Managing the provision of external legal support including managing and monitoring cost and managing quality.
  • Building collaborative relationships with internal and external stakeholders.
  • To be successful
  • UK qualification as a Solicitor or Barrister.
  • Experience of one or more of the following specialisms: commercial law and contract drafting, public procurement law, construction, engineering or infrastructure projects, litigation and dispute resolution.
  • Ability to communicate in a clear, honest and enthusiastic way to build trust, and explain complex issues in a way that is easy to understand.
  • Ability to proactively manage legal and commercial risks and identify solutions.
  • The ability to work quickly across multiple projects/initiatives simultaneously and autonomously.
